This website (“Site”) is owned and operated by Zylo Nutrition LLC ("Zylo", “we,” “us,” “our”) and all its associated entities. If you don't agree with these Terms and Conditions (“Terms”), our Privacy Policy, or any other notices listed within these Terms, we advise against using our Site or Services. Your usage is bound by your acceptance of them.

IMPORTANT: WITHIN THESE TERMS IS A MANDATORY ARBITRATION CLAUSE. BY ACCEPTING THESE TERMS, YOU AGREE THAT ALL DISPUTES WITH ZYLO WILL BE SETTLED ON AN INDIVIDUAL BASIS THROUGH ARBITRATION, AS EXPLAINED IN THE DISPUTE RESOLUTION SECTION. THIS PREVENTS YOU FROM PARTICIPATING IN CLASS ACTIONS AGAINST ZYLO.

Scope: These Terms encompass all Site users, including but not limited to browsers, vendors, and contributors of content. These Terms oversee the Site and all its related tools, products, and services unless otherwise specified by a mutual agreement.

Before utilizing our Services, please review these Terms thoroughly. By accessing the Site or its Services, you consent to these Terms. Disagreement with any of the Terms means you shouldn't access or utilize the Services. If these Terms are viewed as an offer, then acceptance is strictly as per these Terms.

Purchases, Returns, and Exchanges: We operate an online store, supported by Shopify, where our products (“Products”) are available. Returns or exchanges are as per our Return Policy. Typically, we accept returns within a stipulated time after a purchase. If unsatisfied with a product, your only solution is to return the unused portion for a refund. After the return period ends, the sale becomes final with no returns or refunds. We may, at our discretion, restrict sales based on person, region, or quantity. We also reserve the right to adjust product descriptions, change pricing, or cease any product without notice. We're not accountable to you or third parties for any product modifications, price adjustments, or product discontinuation.

Product Descriptions: While we aim to be precise with product descriptions, we can't guarantee their complete accuracy or that they're free of errors. If a product you receive differs significantly from its description, return it as per our return policy. We also strive to ensure accurate product pricing, but there might be rare pricing errors. In such cases, we'll inform you of the correct price before shipment, giving you a chance to cancel or proceed with the order.

To make purchases via our Services, you should be at least 18 years old, provide valid payment details, and authorize us to charge for the Products or Services you select.

Personal Use Only: All product orders should be for personal use. Reselling our Products through third-party platforms, including but not limited to Amazon, Etsy, and eBay, is strictly forbidden. We retain the right to reject or cancel orders that appear to be from resellers.

No Professional or Medical Advice: Our Services offer information, not medical advice or treatment. Consult with healthcare professionals for health-related queries before using our products or relying on our information.

Prohibited Uses: The Site should not be used for any unauthorized or illegal activities. Misuse might lead to termination of your access.

• Name and Logos: The Zylo name and logos are trademarks of Zylo Nutrition LLC. No part of these Terms grants rights to use the Zylo trademarks without our written consent.
• Material on the Site: All content, unless otherwise stated, is copyrighted by Zylo. Reproducing or transmitting any of the Site’s content without our permission is not allowed.
• Third Party Material: Some materials might be from third parties. Zylo isn't responsible for third-party materials' accuracy or any losses arising from their use.

 

Disclaimer of Warranties

By using our products and services, you understand and agree to the following disclaimer:

Zylo Nutrition LLC provides its products and services on an "AS IS" and "AS AVAILABLE" basis. All warranties, whether express, implied, or statutory, relating to the services, products, and all content available through them, are expressly disclaimed. This includes but is not limited to implied warranties of merchantability, fitness for a particular purpose, title, and non-infringement. Zylo Nutrition LLC does not guarantee:

1. A) The products or services will meet your needs. B) Their uninterrupted, timely, secure, or error-free performance. C) That they will be free from harmful components. D) The reliability or accuracy of results obtained. E) Your concerns will be addressed satisfactorily.

The exclusions and disclaimers in this section are enforced to the full extent of the law.

Limitation of Liability

Zylo Nutrition LLC and its affiliates, partners, officers, directors, agents, contractors, licensors, service providers, subcontractors, suppliers, interns, and employees are not liable for any claim related to your use of the products or services, or any resultant damages (be it lost profits, revenue, data, replacement costs, or any kind of direct, indirect, special, consequential, or punitive damages), irrespective of the legal ground.

The above limitations apply to the maximum extent permitted by law.

Indemnification

You agree to indemnify and hold Zylo Nutrition LLC, along with its affiliates, partners, officers, directors, agents, contractors, and employees, harmless from any claim or demand, including attorney fees. This is a result of your actions, breaches of these terms, or violation of any law or third-party rights.

Dispute Resolution & Arbitration Agreement

Disputes or claims related to the site, these terms, our products, or services are exclusively resolved through binding arbitration, not in court (with the exception of small claims court, if applicable). You waive your right to a court trial. Arbitration will be administered by the American Arbitration Association ("AAA") under its rules. Any party can initiate arbitration with written notice and a demand to the AAA. We each agree that any dispute resolution proceedings will be conducted only individually, not in class or representative form.

All claims against us must be brought in your individual capacity. If you disagree with any of the terms, inform us in writing and stop using our products, services, and website.

Governing Law

Except for the arbitration clause, these terms are governed by the laws of New York. Any dispute that falls outside the arbitration clause will be subject to the jurisdiction of New York courts. By agreeing, you waive your right to a jury trial.

Notice for California Users

California users are entitled to specific consumer rights as described in California Civil Code Section 1789.3.

Severability

If any provision here is unlawful, void, or unenforceable, it will be deemed severed and won't affect other provisions' validity and enforceability.

Entire Agreement

These terms, combined with any associated policies, constitute the entire agreement between us, overriding all prior agreements and communications. Ambiguities won't be held against the drafting party.
